Terms of Service

These Terms of Service ("Terms") govern your use of Collectorista, operated by Collectorista ("we," "us," or "our"). By creating an account or using the platform, you agree to these Terms.
1. The Service
Collectorista is a collection management platform that provides encrypted cataloging, documentation, and collaboration tools for private collections.
2. Zero-Knowledge Architecture: What This Means for You
Collectorista uses client-side encryption. Your collection data is encrypted on your device before transmitted to our servers. We do not possess the keys to decrypt your data.
Important consequences:
- You are solely responsible for your master password and recovery keys. We cannot reset your password or recover data if you lose both. No backdoor exists.
- If you lose your master password and recovery keys, your data is permanently inaccessible. We are not liable for data loss from lost credentials.
- Data export is your responsibility. We provide export tools. Maintain regular local backups.
3. Accounts
Eligibility
Must be at least 16 years old and legally capable. If using on behalf of an organization, you have authority to bind it.
Account Security
You are responsible for:
- Maintaining master password confidentiality
- Storing recovery keys securely
- All activity under your account
- Promptly notifying support@collectorista.com of unauthorized access
One Person, One Account
Each account is for a single individual. Team access uses role-based invitations.
4. Subscription and Payment
Plans and Pricing
Current plans at collectorista.com/pricing. We may change pricing with 30 days' notice.
Billing
- Subscriptions billed monthly or annually
- Annual subscriptions billed in full at the start
- Payment processed by Stripe
Usage Limits
Each plan includes limits on items, team members, and storage. If exceeded:
- We notify you
- Provide reasonable window to upgrade
- Will not delete data without notice
- May restrict adding new items
Refunds
- Annual: Pro-rated refund within first 30 days
- Monthly: No partial-month refunds

5. Your Data
Ownership
You own your collection data. We claim no intellectual property rights over your content.
License to Operate
You grant us a limited license to store encrypted data and process metadata necessary to operate. Terminates on account deletion.
Prohibited Content
You may not use Collectorista to:
- Store illegal content
- Document illegal collections
- Facilitate money laundering or sanctions evasion
Data Portability
Export decrypted data any time via export function. Standard formats (JSON, CSV, PDF).
Account Deletion
Upon deletion:
- Encrypted data permanently deleted within 30 days
- Metadata retained up to 90 days
- Billing records retained 7 years
This is irreversible.
6. Team Access and Shared Collections
Roles and Permissions
Owner, Curator, Advisor, Insurance, Viewer — each with defined data access.
Owner Responsibilities
As an organization owner, you are responsible for:
- Managing team access
- Ensuring compliance
- Revoking access when members leave
Key Sharing
Team access requires cryptographic key exchange. Revoking access removes key access going forward but cannot retroactively un-share decrypted data.
7. Acceptable Use
You agree not to:
- Reverse engineer the platform
- Attempt to access others' data
- Use automated scraping
- Interfere with infrastructure
- Impersonate others
- Send spam
- Resell access
8. Intellectual Property
Our IP
Platform design, code, brand, and documentation is our intellectual property.
Your IP
Your collection data remains your intellectual property. We don't use your content beyond providing the service.
9. Availability and Support
High availability aimed but not guaranteed. Support response times vary by plan:
- Starter: Best-effort
- Collector: Priority
- Connoisseur: Faster targets
- Estate: Dedicated manager
10. Limitation of Liability
Platform provided "as is." Total liability limited to amount paid in the preceding 12 months. We are not liable for:
- Data loss from lost passwords
- Decisions based on collection data
- Indirect damages
- Loss of profits
EU consumer rights are preserved.
11. Indemnification
You indemnify us from claims arising from your use, content, or violations. Does not apply where claim arises from our negligence.
12. Termination
By you: Cancel anytime via settings.
By us: For material breach, non-payment, legal requirement, or service discontinuation (90 days notice + export opportunity).
13. Dispute Resolution
Governed by Portuguese law. Jurisdiction: Lisbon courts. EU consumers may use their country of residence.
Informal resolution encouraged first via legal@collectorista.com.
14. General
Entire agreement (with Privacy Policy), severability, no waiver, assignment in M&A only, notices to account email.
15. Changes to These Terms
Material changes communicated 30 days before. Continued use constitutes acceptance. You may cancel if you disagree.
